Your Rights in Immigration Detention

Even non-citizens have constitutional rights. You have the right to remain silent and the right to speak with an attorney. You do not have to consent to a search of your home without a warrant signed by a judge.

ICE Encounter — What To Do

  • Stay calm and do not run
  • Ask "Am I free to go?"
  • Do not sign any documents without an attorney
  • Memorize or carry your attorney's phone number

Bond hearings in immigration court allow a judge to set bond so the detained person can be released while their case proceeds.
