Can I sue my doctor for a misdiagnosis that delayed my cancer treatment?

My doctor told me my lump was benign for over a year. A second doctor diagnosed it as cancer at Stage 3. The delay has worsened my prognosis significantly. Do I have a medical malpractice case?

A delayed cancer diagnosis is one of the most common and serious forms of medical malpractice in Texas. To succeed, you must show: (1) the doctor-patient relationship existed, (2) the physician deviated from the accepted standard of care a reasonably competent doctor would follow, (3) that deviation caused your harm (the delay), and (4) you suffered damages as a result. In your case, the key question is whether a competent physician would have ordered a biopsy or further testing given your presentation. Texas Medical Liability Act §74.351 requires a medical expert report within 120 days of filing suit. The statute of limitations is two years from the date you discovered or should have discovered the negligence. Consult a medical malpractice attorney immediately — these cases require early expert review.
