Can my employer fire me for filing a workers' comp claim in Texas?

I hurt my back on the job at a manufacturing plant in Fort Worth. My supervisor told me not to file a workers' comp claim and "handle it through insurance." I filed anyway and now I'm worried about retaliation. Is that legal?

No — retaliating against an employee for filing a workers' compensation claim is illegal under Texas Labor Code §451.001. If your employer fires, demotes, or otherwise discriminates against you because you filed, you have a cause of action for wrongful termination. You can sue for lost wages, reinstatement, and additional damages. Keep a written record of everything your supervisor said and any changes in your treatment after filing.
