In a decision that legal experts are calling one of the most consequential property-rights rulings in a decade, the Texas Supreme Court held that cities lack inherent authority to halt all new development without an explicit grant from the Legislature.

The case, City of Westfield v. Talbot Properties LLC, arose when the City of Westfield imposed an 18-month moratorium on commercial construction permits following a disputed water-capacity study.

What the Court Said

Justice Elena Morales, writing for the majority, stated that "home-rule authority does not extend to actions that effectively nullify state-law property interests without compensation." The dissent argued the ruling would hamstring local governments in managing rapid growth.
