I was charged with assault — can I claim self-defense in Texas?

I got into a fight outside a bar in San Antonio after someone shoved me first and kept coming at me. I pushed him back hard and he fell and got hurt. Now I'm charged with assault. Can I use self-defense?

Texas Penal Code §9.31 allows a person to use force against another when they reasonably believe it is immediately necessary to protect themselves from the other person's use of unlawful force. The key elements are: (1) you had a reasonable belief force was necessary, (2) you did not provoke the other person, and (3) you did not have a duty to retreat (Texas is a Stand Your Ground state). The fact that he initiated physical contact and continued toward you strengthens a self-defense claim. Hire a criminal defense attorney immediately — do not speak to police without one present.
