What happens if the other driver in my accident has no insurance?

I was hit by an uninsured driver in Dallas last month. My car has $8,000 in damage and I have medical bills. The other driver has nothing. What are my options?

First, check your own auto insurance policy for Uninsured/Underinsured Motorist (UM/UIM) coverage — Texas law requires insurers to offer it, and if you have it, your own insurance will cover your damages up to the policy limit regardless of the other driver's status. If you declined UM/UIM in writing, you can still sue the uninsured driver personally, but collecting is difficult if they have no assets. You may also have a claim under your own collision coverage (subject to your deductible).
