Texas Health and Safety Code divides controlled substances into Penalty Groups 1–4. The severity of a possession charge depends on the substance and the amount.

Penalty Group 1 (Cocaine, Heroin, Meth)

  • Under 1g: State jail felony
  • 1–4g: 3rd-degree felony
  • 4–200g: 2nd-degree felony
