Suing in Texas Small Claims Court

Texas Justice Courts (often called small claims courts) have jurisdiction over civil cases where the amount in controversy is $20,000 or less, excluding interest and attorney's fees.

Filing Process

  1. File a petition at the Justice Court in the county where the defendant lives or where the contract was to be performed
  2. Pay the filing fee (typically $46–$100)
  3. Serve the defendant via constable or certified mail
  4. Attend the hearing with all evidence and witnesses
