Can I sue a nursing home for neglect of my mother?

My 78-year-old mother developed severe bedsores at a nursing home in Houston while I was visiting her less frequently during COVID. The staff clearly wasn't turning her. She passed away six months ago. Do I have a case?

Yes, nursing home neglect claims are actionable in Texas under both negligence theory and the Texas Health & Safety Code §242.001 et seq., which imposes a duty of care on long-term care facilities. Bedsores (pressure ulcers) at Stage 3 or 4 are widely considered a preventable sentinel event — evidence of inadequate care. Because your mother passed away, this may also give rise to a wrongful death and survival action under Texas Civil Practice & Remedies Code §71.001. The statute of limitations for these claims is generally two years, so you should consult a personal injury attorney with nursing home experience as soon as possible.
