I was rear-ended at a red light — is the other driver automatically at fault?

A driver rear-ended my car at a stoplight in Houston last week. My neck has been sore since. The other driver's insurance is asking me to give a recorded statement. Should I agree to that?

Do NOT give a recorded statement to the other driver's insurance company. You are under no legal obligation to do so, and anything you say can be used to minimize or deny your claim. In Texas, the rear driver is almost always found at fault for failing to maintain a safe following distance under Transportation Code §545.062. Get medical attention immediately and document everything. Consult a personal injury attorney before speaking to any insurance adjuster — most offer free consultations and work on contingency.
